Celiksoy Law Firm PC is a professional corporation formed under the laws of the State of California. Its attorneys are admitted to and regulated by the State Bar of California.

Celiksoy Law Firm PC is responsible for the personal information it collects and holds in connection with its US enquiries and client matters. We handle that information in accordance with applicable United States federal and California law and with our professional obligations as attorneys.

2. Our relationship with the UK practice

Celiksoylaw.com also provides access to United Kingdom legal services offered separately by Bekenbey Solicitors Ltd.

Celiksoy Law Firm PC and Bekenbey Solicitors Ltd are separate legal entities and separate professional practices operating in different jurisdictions.

Celiksoy Law Firm PC is responsible for its US enquiries and US client matters. Bekenbey Solicitors Ltd is separately responsible for its United Kingdom enquiries and client matters.

Submitting a US enquiry or instructing Celiksoy Law Firm PC does not mean that you have instructed Bekenbey Solicitors Ltd.

US enquiry forms are directed to Celiksoy Law Firm PC. Information provided in connection with US enquiries and US client matters is not routinely shared with Bekenbey Solicitors Ltd.

The fact that both practices are presented through the same website does not create a joint client relationship or a shared client file.

3. Personal information we collect

The information we collect depends on the nature of your enquiry and the legal services you ask us to provide.

It may include:

  • your name, any other names you have used, and your date and place of birth;
  • nationality, citizenship and immigration status;
  • postal address, email address and telephone number;
  • passport and identity information;
  • US immigration identifiers, such as an Alien Registration Number (A-Number), USCIS receipt numbers, I-94 records and, where relevant, a Social Security number;
  • visa, immigration and travel history;
  • family and relationship information, including information about a spouse, children or other relatives;
  • employment and business information, including information about a petitioning employer or a business you own or plan to establish;
  • education, qualifications, publications, awards and other professional achievements;
  • financial information, including income, savings, investments or source-of-funds evidence where relevant;
  • documents provided in connection with a petition, application or legal matter;
  • correspondence and communications with you;
  • notes of consultations, meetings and telephone calls;
  • information required for identity, conflict or professional-responsibility checks; and
  • any other information reasonably necessary to advise or represent you.

We seek to collect only information that is relevant and reasonably necessary for the purpose for which it is required.

4. Sensitive personal information

Immigration matters can involve particularly sensitive personal information.

Depending on your circumstances, this may include:

  • Social Security, passport and other government identification numbers;
  • racial or ethnic origin;
  • religious or philosophical beliefs;
  • health or medical information;
  • sex life or sexual orientation;
  • biometric information collected by government agencies in connection with an application; and
  • information about criminal history, arrests, charges or immigration violations.

We collect and use sensitive personal information only where it is necessary to provide the legal services you have requested, to comply with our legal and professional obligations, or to establish, exercise or defend legal claims. We do not use sensitive personal information to infer characteristics about you.

5. Information we receive from other people

Where relevant to your matter, we may receive information about you from another person or organisation.

This may include:

  • a spouse, family member or other beneficiary of a petition;
  • a petitioning employer, business partner or investor;
  • an educational or research institution;
  • persons providing letters of recommendation or support;
  • a credential evaluator, interpreter or translator;
  • another attorney or professional adviser;
  • an expert;
  • a US government agency, such as US Citizenship and Immigration Services, the Department of State, the Department of Labor or US Customs and Border Protection; or
  • another person involved in your legal or immigration matter.

Where personal information is obtained from another source, we will handle it in accordance with our legal and professional obligations.

6. Information submitted through the website

Where you complete a US enquiry, contact or eligibility assessment form on celiksoylaw.com, the information you provide is directed to Celiksoy Law Firm PC for the purpose of dealing with your US enquiry.

US enquiry information is not automatically sent to the UK practice.

Submitting a form does not by itself create an attorney-client relationship. Please avoid submitting information that is unnecessary for your enquiry, particularly sensitive documents, unless they are relevant to the service you are requesting.

7. Why we use your information

We may use personal information for the following purposes.

Responding to your enquiry

  • responding to your enquiry;
  • understanding the assistance you are seeking;
  • determining whether we may be able to act;
  • carrying out conflict checks; and
  • arranging a consultation where appropriate.

Providing legal services

If you engage us, we use your information to:

  • provide legal advice;
  • assess your immigration position and the routes that may be available to you;
  • prepare petitions, applications and supporting evidence;
  • communicate with you;
  • communicate with US government agencies and relevant third parties; and
  • manage and progress your matter.

Legal and professional obligations

We may process personal information to comply with legal and professional requirements, including:

  • identity verification and conflict checking;
  • the California Rules of Professional Conduct and other obligations that apply to attorneys;
  • client trust accounting, recordkeeping and tax obligations;
  • professional liability insurance requirements; and
  • responding to courts, regulators or other authorities where legally required.

Managing and protecting our practice

We may also use information for purposes such as:

  • maintaining client and business records;
  • responding to complaints;
  • establishing or defending legal claims;
  • information security;
  • preventing fraud or misuse; and
  • operating and protecting our legal practice.

8. Marketing

We do not currently use personal information collected through US legal enquiries or client matters to send marketing emails.

If our marketing practices change in the future, this Privacy Policy will be updated and any consent or other legal requirement applicable at that time will be respected.

9. Who we may share your information with

We do not sell personal information, and we do not share personal information for cross-context behavioural advertising.

Where necessary for your matter, our professional obligations or the proper operation of our practice, information may be provided to categories of recipients including:

  • US Citizenship and Immigration Services and the Department of Homeland Security;
  • the Department of State, the National Visa Center and US embassies and consulates;
  • the Department of Labor;
  • US Customs and Border Protection;
  • immigration courts and other courts and tribunals;
  • other attorneys, experts, credential evaluators, interpreters and translators instructed on your matter;
  • accountants, auditors, insurers and professional advisers;
  • payment providers where applicable;
  • case-management, document-management, email, hosting and IT service providers;
  • the State Bar of California;
  • law enforcement bodies where disclosure is lawfully required; and
  • other persons or organisations where disclosure is necessary for your matter or required by law.

Where an organisation processes personal information on our behalf, we take appropriate steps to ensure that it is handled securely and only for authorised purposes.

10. No routine sharing with the UK firm

Bekenbey Solicitors Ltd is not a routine recipient of US client or enquiry information.

Celiksoy Law Firm PC does not routinely provide US client files, US enquiries, supporting evidence or other client information to Bekenbey Solicitors Ltd.

There is no routine sharing of client information between the two firms merely because their services appear on celiksoylaw.com.

If there were an exceptional circumstance in which information needed to be disclosed to another organisation, including the UK firm, it would only be disclosed where you have requested or authorised it, or where there is another lawful basis for doing so, and in accordance with our professional obligations concerning confidentiality.

11. If you are outside the United States

Celiksoy Law Firm PC is based in the United States, and personal information we collect is stored and processed in the United States.

If you contact us from outside the United States, your information will be transferred to the United States, where data protection laws may differ from those in your country. For a US immigration matter, the information needed for a petition or application must be provided to US government agencies in order for the application to be made.

We do not transfer your personal information to Bekenbey Solicitors Ltd simply because its services are also presented on celiksoylaw.com.

12. How long we keep your information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and to meet our legal, professional and insurance obligations.

Client matter files will ordinarily be retained for at least seven years after the matter closes, unless there is a legal, professional or case-specific reason to keep particular information for a different period. Client trust account records are kept for the period required by the California Rules of Professional Conduct.

Immigration matters may sometimes justify a longer retention period, because information concerning an earlier petition or immigration history may be relevant to a future immigration, naturalisation or legal matter.

Information relating to enquiries that do not become client matters will be retained only for a reasonable period, having regard to matters such as enquiry management, conflict checking and potential legal claims.

When personal information is no longer required, it will be securely deleted, destroyed or anonymised as appropriate.

13. How we protect your information

We take reasonable technical and organisational measures designed to protect personal information from unauthorised access, accidental loss, unlawful disclosure, alteration, destruction or misuse.

Measures may include access-controlled systems, authentication and security controls, restricted access to client information, secure document-sharing arrangements and confidentiality obligations.

Access to personal information is limited to individuals who require it for legitimate professional or administrative purposes.

If a security breach affects your personal information, we will notify you where required by California law.

14. Professional confidentiality

As California attorneys, we are subject to a duty to maintain client confidences under California Business and Professions Code section 6068(e) and the California Rules of Professional Conduct, and communications with us may be protected by the attorney-client privilege.

Those professional obligations operate alongside our responsibilities under privacy law.

Nothing in this Privacy Policy reduces the professional duties of confidentiality that apply to information held in connection with our legal practice.

15. Your California privacy rights

The California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives California residents rights over their personal information where a business meets the thresholds set by that law. Celiksoy Law Firm PC does not currently meet those thresholds.

Although that law does not currently apply to us, we will consider a request from you to:

  • know what personal information we hold about you and how we use it;
  • correct inaccurate personal information; or
  • delete personal information we no longer need to keep.

These rights are not absolute. We may need to retain or withhold certain information because of legal or professional requirements, the attorney-client privilege, the establishment or defence of legal claims, or duties of confidentiality owed to another person.

We will not discriminate against you for making a request. You may make a request yourself or through an authorised agent, and we may ask for information necessary to verify your identity, or the agent’s authority, before acting on it.

Requests should be sent to us@celiksoylaw.com.

California Civil Code section 1798.83 allows California residents to ask whether a business has disclosed personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.

16. Do Not Track and Global Privacy Control

Some browsers can send a “Do Not Track” or Global Privacy Control signal. This website does not track visitors across other websites and does not sell or share personal information, so there is no such activity for these signals to switch off. Optional cookies on this website remain off unless you choose to enable them, as explained in our Cookies Policy.

17. Automated decision-making

We do not use solely automated decision-making to provide legal advice or make professional assessments concerning your legal or immigration matter.

Legal advice and case assessments are undertaken by attorneys and appropriately supervised staff.

Government agencies may use their own automated or technology-assisted systems. We do not control the way those agencies process information.

18. Cookies

Celiksoylaw.com has a separate Cookies Policy, which explains the use of cookies and similar technologies on the website.

Please refer to the Cookies Policy for further information.

19. Information about children

This website is not directed at children under 13, and we do not knowingly collect personal information online from children under 13.

Our legal work may involve personal information relating to children, including where a child is a beneficiary, applicant or family member relevant to an immigration matter. We process children’s information only where it is reasonably necessary for the relevant legal matter, and we take instructions from a parent, guardian or other person legally entitled to provide them.

20. Changes to this Privacy Policy

We may update this Privacy Policy where our practices, website functionality or legal and professional requirements change.

The Last updated date at the top of this page shows when the policy was most recently revised.

Where a material change affects the way we process information relating to an existing client, we will take appropriate steps to bring that change to the client’s attention.
