This case formed part of a broader family-based change of status strategy following the father’s successful transition from B-2 visitor status to F-1 student status. Once his F-1 classification was approved, it was important that his minor child’s immigration status properly correspond with the principal student’s new status.
Our office therefore prepared and pursued a Form I-539 application requesting F-2 dependent status for the child. The application was based on the child’s qualifying relationship to the F-1 student and the father’s approved student status.
This approval completed another important part of the family’s immigration transition. Rather than viewing the father’s F-1 approval as an isolated result, the case required coordinating the statuses of his dependents so that the family could remain together under the appropriate F-1/F-2 structure while he pursued his studies in the United States.
