Our client pursued permanent residence as the spouse of an EB-2 National Interest Waiver principal applicant. His wife, a pediatric dentist, professor, and academic leader, had previously obtained approval of her EB-2 NIW petition based on her work in pediatric dentistry, dental genetics, inherited enamel disorders, and medical education.
After the family entered the adjustment of status stage, our client filed Form I-485 as a derivative applicant. While that application remained pending, our firm also prepared and filed his Form I-131 request for Advance Parole so that he could obtain travel authorization during the pendency of the adjustment process.
USCIS approved the Advance Parole application, providing our client with travel authorization while his EB-2 NIW-based adjustment of status case remained pending. The approval formed an important interim step in the family’s broader transition from an approved immigrant petition to lawful permanent residence.
