Our client pursued adjustment of status as the spouse of an approved EB-2 National Interest Waiver principal applicant. Her husband, a radiologist and cardiothoracic imaging specialist, had previously obtained approval of his EB-2 NIW petition based on his work in advanced diagnostic imaging, interstitial lung disease, prostate MRI, and AI-assisted diagnostics.
As a derivative applicant, she filed Form I-485 as part of the couple’s permanent residence process. While that application remained pending, our firm submitted a separate Form I-765 application under the (c)(9) category to request employment authorization.
USCIS approved her Form I-765 application and granted employment authorization, allowing her to work in the United States while her derivative adjustment of status case continued through the EB-2 NIW-based permanent residence process.
