Our client pursued adjustment of status as the spouse of an approved EB-2 National Interest Waiver principal applicant. Her husband, a radiologist and cardiothoracic imaging specialist, had previously obtained approval of his EB-2 NIW petition based on his work in advanced diagnostic imaging, interstitial lung disease, prostate MRI, and AI-assisted diagnostics.
As a derivative applicant, our client proceeded with Form I-485 as part of the couple’s permanent residence process. While her adjustment application remained pending, our firm separately filed Form I-131 to request Advance Parole.
USCIS approved the Form I-131 application and granted her Advance Parole, providing travel authorization while her derivative adjustment of status case continued. The approval formed part of the couple’s coordinated transition through the EB-2 NIW-based permanent residence process.
