This case involved the child of an approved EB-2 National Interest Waiver principal applicant. His mother, a pediatric allergy and immunology specialist and clinician-scientist, had previously secured approval of her EB-2 NIW petition based on her work in transplantation immunology, immune tolerance, and reducing organ rejection.
As the principal applicant’s derivative child, our client filed Form I-485 as part of the family’s adjustment of status process. While that application remained pending, our firm submitted a separate Form I-765 application under the (c)(9) adjustment of status category.
USCIS approved the Form I-765 application and granted employment authorization. The approval represented another milestone in the child’s derivative immigration process while the family continued toward lawful permanent residence through the approved EB-2 NIW petition.
