This case involved the child of an approved EB-2 National Interest Waiver principal applicant. His mother, a pediatric allergy and immunology specialist and clinician-scientist, had previously secured approval of her EB-2 NIW petition based on her work in pediatric immunology, transplantation research, and immune tolerance.
As the principal applicant’s derivative child, our client proceeded with Form I-485 as part of the family’s adjustment of status process. While that application remained pending, our firm filed a separate Form I-131 application requesting Advance Parole.
USCIS approved the Advance Parole request, providing the child with travel authorization while his adjustment of status case continued to be processed. The approval supported the family’s coordinated progress through the EB-2 NIW-based permanent residence process.
