This case involved the child of an approved EB-2 National Interest Waiver principal applicant. Her mother, a pediatric dentist and academic leader, had previously secured approval of her EB-2 NIW petition based on her professional and scholarly work in pediatric dentistry, dental genetics, and inherited enamel disorders.
As the principal applicant’s derivative child, our client proceeded with Form I-485 during the family’s adjustment of status process. Because the adjustment application remained pending, a separate Form I-131 application was filed to obtain Advance Parole travel authorization.
USCIS approved the child’s Advance Parole request, allowing her to receive travel authorization while her adjustment of status application continued to be processed. The approval supported the family’s ability to move through the EB-2 NIW-based permanent residence process while maintaining the appropriate travel documentation for the derivative child.
