Our client’s mother obtained E-2 treaty investor status after establishing and investing in a vehicle rental business in Illinois serving Naperville and the greater Chicago area. Following the principal applicant’s E-2 approval, the family proceeded with the dependent applications necessary to align their immigration classifications with the investor’s status.
As the child of the principal E-2 treaty investor, our client applied for E-2Y dependent status through Form I-539. Her eligibility for the classification arose from her qualifying relationship to the principal investor and the continued validity of her mother’s E-2 status.
USCIS approved the application and granted her E-2Y status as the dependent child of an E-2 treaty investor. The approval allowed her to remain in the United States in the appropriate dependent classification while her mother continued operating and developing the family’s U.S. business.
