This approval represents the successful continuation of a family’s immigration strategy in the United States. Our office had previously represented the applicant’s spouse in a change of status case from B-2 visitor status to F-1 student status. Once his F-1 status was approved, the next step was to ensure that his wife’s immigration status was properly aligned with his new student classification.
We therefore pursued F-2 dependent status for his spouse through Form I-539. The case required presenting the marital relationship together with the principal F-1 student’s approved status and demonstrating the basis for the dependent classification. USCIS ultimately approved the application and granted her F-2 status for the duration of her spouse’s F-1 status.
The result allowed the couple’s immigration statuses to work together as intended under the F-1/F-2 framework. What began with the husband’s transition from visitor status to student status was completed by securing the corresponding dependent status for his spouse, enabling the family to remain together in the United States while he continues his academic program.
