Our client pursued permanent residence as the spouse of an EB-2 National Interest Waiver principal applicant. His wife, a pediatric allergy and immunology specialist and clinician-scientist, had previously obtained approval of her EB-2 NIW petition based on her work in pediatric immunology, transplantation research, and immune tolerance.
Following the immigrant petition approval, the family proceeded with the adjustment of status stage of the permanent residence process. As a derivative spouse, our client filed Form I-485 and also sought Advance Parole through Form I-131 while his adjustment application remained pending.
USCIS approved the Advance Parole application, providing our client with travel authorization during the pendency of his adjustment of status case. The approval was an important interim benefit in the family’s broader EB-2 NIW-based path toward lawful permanent residence.
