Our client’s spouse is a physician and postdoctoral neurosurgical researcher whose work focuses on minimally invasive brain and spine surgery, advanced surgical imaging, and approaches designed to improve surgical precision while protecting healthy neurological structures. Our firm previously secured approval of his Form I-140 petition under the EB-2 National Interest Waiver category, allowing the couple to proceed with the adjustment of status stage of their permanent residence process.
As the derivative spouse of the approved EB-2 NIW principal applicant, our client filed her own adjustment of status application. Our firm also prepared and submitted Form I-131 on her behalf to request Advance Parole while her permanent residence application remained pending.
USCIS approved the Form I-131 application and granted Advance Parole. The approval provided our client with an authorized travel document that she could use when seeking parole into the United States following international travel, while continuing her adjustment of status process. Together with her separately approved employment authorization, the Advance Parole approval gave the family additional flexibility as their EB-2 NIW-based permanent residence cases continued.
