2. Our relationship with the US practice

Celiksoylaw.com also provides access to United States legal services offered separately by Celiksoy Law Firm PC.

Bekenbey Solicitors Ltd and Celiksoy Law Firm PC are separate legal entities and separate professional practices operating in different jurisdictions.

Bekenbey Solicitors Ltd is responsible for its UK enquiries and UK client matters. Celiksoy Law Firm PC is separately responsible for its United States enquiries and client matters.

The fact that both practices are presented through the same website does not create a joint client relationship or a shared client file.

Where you complete a UK enquiry, contact or eligibility assessment form on celiksoylaw.com, the information you provide is directed to Bekenbey Solicitors Ltd for the purpose of dealing with your UK enquiry.

UK enquiry information is not automatically sent to the US practice.

Please avoid submitting information that is unnecessary for your enquiry, particularly sensitive documents, unless they are relevant to the service you are requesting.

7. Why we use your information

We may use personal information for the following purposes.

Responding to your enquiry

We use your information to:

  • respond to your enquiry;
  • understand the assistance you are seeking;
  • determine whether we may be able to act;
  • carry out initial conflict checks; and
  • arrange a consultation where appropriate.

Our lawful basis will generally be taking steps at your request before entering into a contract and, where appropriate, our legitimate interests in responding to enquiries and administering our legal practice.

Providing legal services

If you instruct us, we use your information to:

  • provide legal advice;
  • assess your immigration or legal position;
  • prepare applications and representations;
  • prepare and review supporting evidence;
  • communicate with you;
  • communicate with relevant authorities and third parties; and
  • manage and progress your matter.

Our lawful basis will generally be the performance of our contract with you.

Legal and regulatory obligations

We may process personal information to comply with legal, professional and regulatory requirements.

This may include, where applicable:

  • identity and client verification;
  • conflict checking;
  • regulatory requirements;
  • accounting and tax obligations;
  • anti-money-laundering obligations where applicable;
  • professional indemnity requirements; and
  • responding to regulators, courts or other authorities where legally required.

The applicable lawful basis may include compliance with a legal obligation.

Managing and protecting our practice

We may process information for purposes such as:

  • operating and protecting our legal practice.

Where appropriate, we may rely on our legitimate interests in administering and protecting a regulated legal practice.

We consider the impact of legitimate-interest processing on the rights and interests of the individuals concerned.

8. Marketing

We do not currently use personal information collected through UK legal enquiries or client matters to send marketing emails.

If our marketing practices change in the future, this Privacy Policy will be updated and any consent or other legal requirement applicable at that time will be respected.

9. Who we may share your information with

We do not sell personal information.

Where necessary for your matter, our professional obligations or the proper operation of our practice, information may be provided to categories of recipients including:

  • the Home Office and UK Visas and Immigration;
  • courts and tribunals;
  • other government departments or public authorities;
  • barristers and other legal professionals;
  • experts;
  • interpreters and translators;
  • accountants, auditors, insurers and professional advisers;
  • identity or compliance providers where applicable;
  • payment providers where applicable;
  • case-management, document-management, email, hosting and IT service providers;
  • the Solicitors Regulation Authority;
  • the Legal Ombudsman;
  • law enforcement bodies where disclosure is lawfully required; and
  • other persons or organisations where disclosure is necessary for your matter or required by law.

Where an organisation processes personal information on our behalf, we take appropriate steps to ensure that it is handled securely and only for authorised purposes.

10. No routine sharing with the US firm

Celiksoy Law Firm PC is not a routine recipient of UK client or enquiry information.

Bekenbey Solicitors Ltd does not routinely provide UK client files, UK enquiries, supporting evidence or other client information to Celiksoy Law Firm PC.

There is no routine sharing of client information between the two firms merely because their services appear on celiksoylaw.com.

If there were an exceptional circumstance in which information needed to be disclosed to another organisation, including the US firm, it would only be disclosed where there was an appropriate lawful basis to do so and in accordance with our professional obligations concerning confidentiality.

11. International transfers

We do not transfer your personal information to Celiksoy Law Firm PC simply because its services are also presented on celiksoylaw.com.

Some technology, professional or other service providers used in connection with our UK practice may, where applicable, process information outside the United Kingdom.

Where personal information is subject to a restricted international transfer, we will comply with the requirements of UK data protection law and use an appropriate transfer mechanism or safeguard where required.

12. How long we keep your information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and to meet our legal, regulatory, professional and insurance obligations.

Client matter files will ordinarily be retained for approximately six years after the matter closes, unless there is a legal, regulatory, professional or case-specific reason to keep particular information for a different period.

Immigration matters may sometimes justify a longer retention period because information concerning an earlier application or immigration history may be relevant to a future immigration, nationality or legal matter.

Information relating to enquiries that do not become client matters will be retained only for a reasonable period, having regard to matters such as enquiry management, conflict checking, regulatory requirements and potential legal claims.

When personal information is no longer required, it will be securely deleted, destroyed or anonymised as appropriate.

13. How we protect your information

We take appropriate technical and organisational measures designed to protect personal information from:

  • unauthorised access;
  • accidental loss;
  • unlawful disclosure;
  • alteration;
  • destruction; or
  • misuse.

Measures may include access-controlled systems, authentication and security controls, restricted access to client information, secure document-sharing arrangements and confidentiality obligations.

Access to personal information is limited to individuals who require it for legitimate professional, regulatory or administrative purposes.

14. Professional confidentiality

As an SRA-regulated solicitors’ practice, we are subject to professional obligations concerning client confidentiality.

Those professional obligations operate alongside our responsibilities under data protection law.

Nothing in this Privacy Policy reduces the professional duties of confidentiality that apply to information held in connection with our legal practice.

15. Your data protection rights

Depending on the circumstances and the basis on which we process your information, you may have the right to:

  • request access to personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • request deletion of information in certain circumstances;
  • request restriction of processing in certain circumstances;
  • object to certain processing;
  • receive certain information in a portable format where the right applies; and
  • withdraw consent at any time where processing is based on consent.

These rights are not absolute.

For example, we may need to retain or withhold certain information because of legal or regulatory requirements, legal professional privilege, the establishment or defence of legal claims, or duties of confidentiality owed to another person.

Requests concerning your personal information should be sent to uk@celiksoylaw.com.

We may ask you to provide information necessary to verify your identity before acting on a request.

16. Your right to object

Where we rely on legitimate interests to process your personal information, you may have the right to object to that processing on grounds relating to your particular situation.

To exercise this right, please contact uk@celiksoylaw.com.

We will consider your request in accordance with applicable data protection law.

17. Complaints about data protection

If you have concerns about the way we have handled your personal information, please contact us so that we can investigate and respond.

You also have the right to raise a complaint with the Information Commissioner’s Office (ICO), the UK’s data protection regulator. Further information is available at ico.org.uk.

18. Automated decision-making

We do not use solely automated decision-making to provide legal advice or make professional assessments concerning your legal or immigration matter.

Legal advice and case assessments are undertaken by appropriately authorised individuals.

Government authorities may use their own automated or technology-assisted systems. We do not control the way those organisations process information.

19. Cookies

Celiksoylaw.com has a separate Cookies Policy, which explains the use of cookies and similar technologies on the website.

Please refer to the Cookies Policy for further information.

20. Information about children

Our legal work may involve personal information relating to children, including where a child is an applicant, dependant or family member relevant to an immigration matter.

We process children’s information only where it is reasonably necessary for the relevant legal matter or another lawful purpose.

Where appropriate, instructions or authority will be obtained from a parent, guardian or another person legally entitled to provide them.

21. Changes to this Privacy Policy

We may update this Privacy Policy where our practices, website functionality or legal and regulatory requirements change.

The Last updated date at the top of this page shows when the policy was most recently revised.

Where a material change affects the way we process information relating to an existing client, we will take appropriate steps to bring that change to the client’s attention.
